Lidia Zărnescu, Kinstellar: “Stress is already a psychosocial risk, and employers must take all measures to prevent and combat stress in the workplace”

“In the legal field, at the moment, we are not concerned about the expansion of artificial intelligence. Of course, certain documents can be generated through AI systems, but currently they are not updated and not aligned with the legal provisions.

Considering that our legislation is not very clear and is highly interpretable, and that courts may have different opinions, we believe that legal support is necessary when drafting or implementing various documents,” said Lidia Zărnescu, Managing Associate, Kinstellar, at the People Empowering Business Forum organized by The Diplomat-Bucharest.

    Key statements:

    • “I like to emphasize—and it remains valid—that work is not a commodity, and it will never be. We are a Member State of the European Union, and we have various directives, case law of the Court of Justice of the European Union, International Labour Organization Conventions, and so on.”
    • “There are more and more cases recorded related to stress and burnout. Many employees feel that they have reached a point where they no longer find their place in society, and measures must be identified.”
    • “Burnout and stress fall under workplace harassment, and of course the employer has the obligation to conduct an internal investigation; otherwise, if no such investigation is carried out, the employer could be liable for damages in the event of litigation.”
    • “Depending on the results of this investigation, the employer must adopt the necessary measures. And it is very important that the investigation is impartial and detailed.”
    • “Since we are living in this digital age, we must acknowledge that mental health is extremely important, and the legal obligation to ensure employees’ mental health lies with the employer under labor legislation — and the sanctions are quite significant.”
    • “Stress is already a psychosocial risk, and employers must take all necessary measures to prevent and combat stress at work — through investigations, clearly defined policies on preventing harassment and burnout, AI policies — why not? — and training, because educating employees is essential.”
